Payment

All charges payable by you for the Services shall be in accordance with the charges and rates published by us on our web site, errors and omissions excepted and shall be due and payable in advance of provision of the Services.

We reserve the right to change pricing at any time although all pricing is guaranteed for the period of pre payment.

Payment is due each anniversary month, quarter or year following the date the services were established until closure notice is given in accordance If you choose to pay by with our criteria, credit or debit card you authorise OzHotspots to debit your account renewal fees or access from your card.

All payments must be in Australian Dollars.

If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of $35.00au.

Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled but not obliged forthwith to suspend the provision of Services to you.

Credit card transactions are completed via a secure process. This process starts by entering your credit card information into a secure webpage (SSL) secure certificate once your credit card details have been accepted and the transaction completed you are then able to access the internet.

Termination And Refunds

We shall be entitled to suspend the Services and/or terminate this Agreement forthwith without notice to you If you:

Fail to pay any sums due to us as they fall due.

Break any of these terms and conditions.

Are a company and you go into liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors.

No refunds will be made under any circumstances for Services suspended in accordance with set criteria

We reserve the right to suspend the Services and/or terminate this Agreement at any time. In the event of this You will be entitled to a pro rata refund based upon the remaining period of prepayment.

You may cancel the Services at any time. To do so you must request cancellation of the Services in writing including your account username and password. We will cancel the Services within 2 working days of receipt of your request.

During the first 7 days of Services, You are entitled to a refund of the basic hosting plan rental fee should You decide to cancel the Services. No full refunds or pro rata refunds will be made after the first 7 days of service should You decide to cancel the Services.

You will not be entitled to a refund on this basis if you have previously held an account with OzHotspots.

Where payment has been made by credit or debit card, any refund will only be issued to the same credit or debit card.

On termination of this Agreement or suspension of the Services we shall be entitled immediately to stop access to wireless access.

You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to You and your use of the Services and the Server including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us in consequences of your breach or non-observance of any of the terms of this Agreement.

WIFI CONNECTIONS TERMS AND CONDITIONS

By connecting to OzHotspots WIFI wireless Internet service,
you are agreeing to these terms and related policies.

OzHotspots  Wi-Fi service Terms and Conditions:

OzHotspots supplies WIFI Access during most hours, exceptions being maintenance procedures and internet interuptions, for personal or business use with portable computers or devices capable of receiving wireless signals. These access points allow individuals  access to the Internet from their web-enabled devices when within range of these access points.

Users assume all associated risks and agree to hold harmless OzHotspots and its employees and vendors for any personal information  that is compromised, or for any damage caused to users' hardware or software due to electric surges, security issues or consequences caused by viruses or hacking. All wireless access users should have up-to-date virus protection on their personal laptop computers or wireless devices. OzHotspots provides access to Web-based email only. For Microsoft Outlook or other email services, the users must connect with their own Internet Service Provider (ISP).

Due to the proliferation of Wi-Fi networks, OzHotspots Wi-Fi users may also be able to access other Wi-Fi networks within a specified venue that are not provided by OzHotspots. Use of these non-OzHotspots wireless networks within the venue facilities is also governed by OzHotspots policies. OzHotspots strongly recommends you do not use other Wi-Fi networks.

Venue staff at the reception desk may provide general information on the settings necessary to access the Internet via these connections, but are not responsible for any changes users make to their computer settings and cannot guarantee that a user's hardware will work with OzHotspots  wireless connection. If a user has problems accessing the Internet over these connections, venue staff cannot assist in making changes to the user's network settings or perform any troubleshooting on the user's computer. Users should refer to their owner's manuals or other support services offered by their device manufacturer.

Use of these access points is governed by the OzHotspots Wi-Fi Appropriate Use Policy. All users are expected to use OzHotspots wireless access in a legal and responsible manner, consistent with the public service and informational purposes for which it is provided. Users should not violate law or local laws, including the transmission or receiving of child pornography or harmful material, fraud, or downloading copyrighted material.

Any restriction or monitoring of a minor's access to OzHotspots wireless network is the sole responsibility of the individual.
